Man gets prison term for threat to behead stepdad

Superior Court Associate Judge David A. Wiseman has imposed an 18-month prison sentence on a man who had threatened to behead his stepfather with a machete.

In a written order issued yesterday, Wiseman sentenced Faustino P. Litulumar to two years in prison, all suspended except for 18 months, for assault with a dangerous weapon.

The 22-year-old Litulumar was given credit for the four months and 30 days that he has already served in jail.

He was remanded to the Department of Corrections. His release date is April 14, 2013.

After completing his sentence, Litulumar will be placed on probation for three years. He was ordered to pay a $300 fine, $100 court assessment fee, plus probation fees.

He was also required to perform 200 hours of community service and complete anger management counseling.

Litulumar conceded that because of this new conviction, he violated the terms of his probation in two previous criminal cases. He agreed to place those sentences into effect concurrent with the sentence in this case.

The Office of the Attorney General charged Litulumar with assault with a dangerous weapon and disturbing the peace. He pleaded guilty to assault with a dangerous weapon as part of a plead deal.

Wiseman reluctantly accepted the terms and conditions of the plea agreement.

Detective Peter A. Aldan stated in his report that Litulumar, armed with a machete, had arrived at his mother’s house in Koblerville on Oct. 11, 2011, at 12:30am, and approached his mother who was sitting in the garage.

Litulumar asked his mother where her common-law husband, Terwik Ludwig, was so he could cut his neck. The mother went inse the house and told Ludwig that Litulumar was outside looking for him and threatening to behead him with a machete.

Ludwig jumped out of the bedroom window and ran to the KB Market and Laundry to report the incident to the police.

On April 16, 2011 Litulumar and his girlfriend, Gina Bhagchadani, 37, and his mother Margarita were all arrested for allegedly fighting after a drinking session at their house in Koblerville.

On July 5, 2011, police arrested Litulumar and Bhagchandani for child neglect after their 9-year-old son called the police to report that his parents were always drunk and arguing repeatedly.
