Judge dismisses ‘ice’ case as OAG finds new police report
Camacho dismissed without prejudice the case against Vincent Q. Terlaje after the Office of the Attorney General moved to drop the charge of illegal possession of a controlled substance.
Dismissal without prejudice means the OAG can refile the case in the future.
Assistant attorney general James McAllister made an oral motion to dismiss the case against the 35-year-old Terlaje based on the fact that the government obtained a new police report that warrants the dismissal.
According to the first amended information, Terlaje was found in possession of “ice” on Feb. 19, 2014, on Saipan.
Attorney Jennifer Dockter, counsel for Terlaje, has moved to suppress evidence, citing that nothing supports a warrant for the search of drugs at the defendant’s residence.
Dockter said the police nonetheless included drugs in the search warrant and unlawfully relied on a K9 Unit to search the house.
The same amended information charged Kyle K. Cabael and Kelvin K. Muna with one count each burglary, theft, and conspiracy over the burglary at Monte Vista Hotel and Restaurant, where cash and several items were stolen from one of the rooms on Feb. 17, 2014.
