Woman in fake marriage case gets 2 years probation
The federal court has slapped a two-year probation sentence against a woman who was convicted in a fake marriage case.
At a hearing Tuesday afternoon, U.S. District Court for the NMI Chief Judge Ramona V. Manglona ordered Xiaoying Tang to report to an immigration official for removal proceedings the next day, Wednesday, at 10am.
Tang earlier asked the court to sentence her as early as possible because she wants to return to China due to her father’s illness and her recent discovery that she is pregnant.
Attorney Joseph Horey, court-appointed counsel for Tang, recommended a sentence of one year probation and that she be ordered to surrender to U.S. Immigration for deportation so that she may return to her family.
Horey said Tang wants to go back to China as soon as possible because her father has lung cancer and she recently discovered she’s pregnant and due to deliver in December 2014.
Last January, a federal jury found Tang guilty of conspiracy to defraud the United States, visa fraud, and false statement.
The indictment charged Tang and Jesse Juan Teigita Dowai with conspiracy to commit visa fraud and to defraud the U.S., visa fraud, and false statement for entering into a sham marriage. Dowai pleaded guilty to the conspiracy to commit visa fraud and to defraud the U.S.
