Quichocho files taxpayer’s suit vs Inos over casino law
Lawyer Ramon K. Quichocho has filed in Superior Court a taxpayer’s lawsuit that questioned the constitutionality of the 2-month-old casino law.
Quichocho filed the lawsuit on Wednesday for himself and on behalf of the CNMI taxpayers. He named as defendants Gov. Eloy S. Inos, the CNMI government, and the Lottery Commission.
The lawyer is suing for alleged violation of the NMI Constitution, illegal expenditure of public funds, breach of fiduciary duty, and breach of trust.
Quichocho asked the court to declare the casino law and any expenditure of public funds under that law as unconstitutional and unlawful.
He asked the court to issue a temporary restraining order and preliminary injunction, preventing Inos and co-defendants from performing any rights or obligations under the casino law, pending the resolution and final disposition of the lawsuit.
He also asked the court to issue a permanent injunction restraining the defendants from performing any rights and obligations under the casino law.
Quichocho is asking for payment of unspecified damages, attorney’s fees, and costs.
Quichocho stated in his complaint that this case is about an unconstitutional casino law that was passed only by the votes of some conflicted representatives in the House, and only by the votes of some conflicted senators, and signed by a conflicted governor.
