IPI satisfies judgment in case filed by law firm

Imperial Pacific International (CNMI) LLC has satisfied the judgment against it in the case filed by the law firm of Banes Horey Berman & Miller.

The law firm filed an acknowledgement of satisfaction of judgment with the U.S. District Court for the NMI last Tuesday after the check IPI tendered cleared the bank.

Richard Miller, who represents the law firm in this case, said that IPI’s check cleared the bank last month.

“[Plaintiffs] acknowledge full and complete satisfaction of the judgment in this matter, including all attorney fees and costs, and suggests that entry of satisfaction of the judgment be entered on the docket and the case closed,” Miller said.

According to court documents, IPI owed the law firm over $120,000 in attorney’s fees and expenses on all matters for which the law firm performed legal services for the casino investor.

On Feb. 10, 2021, the U.S. District Court for the NMI entered judgment against IPI in the amount of $114,311.38, including prejudgment interest at a rate of 9%, plus post-judgment interest at a rate of 0.07% per annum, along with costs.

On March 26, 2021, the court ordered IPI to pay the plaintiff reasonable attorney’s fees and costs of bringing the enforcement action.

On Sept. 24, 2021, the court issued an order to show cause why IPI should not be held in contempt for failure to make payment.

On Oct. 7, 2021 the court found IPI was in contempt and granted the plaintiff attorney’s fees and costs.

Sometime after, the law firm and IPI agreed to compromise on the remaining amounts due on the judgment, including attorney’s fees and costs, for the sum of $67,000.

On Oct. 20, 2021, IPI gave the law firm a personal check in the amount of $67,000 and the check cleared later that same day.

Miller and IPI attorney Stephen Nutting, through a stipulation, have asked the federal court to discharge the order to show cause.
