Law firm requests for hearing with IPI
A law firm that is suing Imperial Pacific International (CNMI) LLC for breach of contract has requested the U.S. District Court for the NMI to set a hearing to examine IPI’s ability to pay.
Cong Nie, who represents the law firm of Banes Horey Berman and Miller LLC, said the court had entered a money judgment in the amount of $114,311.38 against IPI last Feb. 10, 2021. To date, IPI has not paid any amount to satisfy the judgment.
The law firm, which sued IPI for breach of contract last September 2020 with the U.S District Court for the NMI, has now filed a request that the court set a hearing to examine IPI’s ability to pay and to issue an order in aid of judgement.
According to the filing, before a money judgment is satisfied in full, a party “may apply to the court for an order in aid of judgment,” and the court “shall hold a hearing on the question of the debtor’s ability to pay.” The court will also determine the fastest manner in which IPI can reasonably pay the judgment based on the finding.
According to Saipan Tribune archives, the law firm represented IPI in the civil lawsuit filed by Pacific Rim Land Development LLC and in the defamation lawsuit filed by USA Fanter Corp. Ltd. It also represented IPI in filing a complaint against FSM Recycling Corp. relating to theft of construction materials at the IPI warehouses.
