Family of man killed in PR crash sues Fabia, Artman
The family of the man who was killed in the collision between a pickup truck and an Artman Environmental Corp. dump truck last Feb. 1 is now suing the Artman and the driver for wrongful death and negligence.
The family of Raju Miah, who is being represented by a close friend, Khorshed Alam, is suing Artman Environmental Corp. and truck driver Eduardo T. Fabia in the CNMI Superior Court for negligence.
Alam said in a filing last Thursday that the dead man’s family have incurred costs and expenses, such as medical expenses, hospital bills, funeral, and other cost related to Miah’s death.
Additionally, Alam said, the Miah family has suffered economic and non-economic damages, severe pain and suffering, emotional and mental distress, and decreased wellbeing.
In Alam’s filing at the U.S. District Court for the NMI, he said that Fabia had a duty to drive reasonably to avoid unreasonable risk of harm to himself and others, and to obey all traffic laws and signs to avoid putting others at risk.
Alam accused Fabia of driving Artman’s truck in a “reckless, negligent, and dangerous manner on a public road” and failed to stop at a red light at a traffic intersection, causing Miah to be killed.
Miah’s family, through Alam, wants a jury trial.
Additionally, the family is seeking compensatory damages, economic and non-economic damages, plus reasonable medical expenses, hospital, funeral, and other related costs incurred because of Miah’s death, and further relief as the court may deem just and proper.
According to Saipan Tribune archives, Miah and Rommel Irang were thrown from the back of a Honda Ridgeline pickup truck when it collided with the Artman dump truck at the Puerto Rico intersection. Irang, who was injured in the crash, is also suing Artman and Fabia.
