Restaurants can’t operate as bars
Restaurants can’t just serve alcohol to patrons.
Restaurants, now open, and with permits to serve alcohol are reminded to guide patrons to order meals, otherwise, or they may be taken as operating as a bar.
Bars are still not permitted to operate with CNMI under the Yellow level vulnerability scale.
Further, restaurants which have attached bars should not allow guests to sit at the attached bar until such time that bars are allowed to operate.
The Commonwealth Healthcare Corp. reiterates that during level Yellow, bars are to remain closed, while restaurants may open for dine-in at 25% of originally permitted occupancy.
“Restaurants [that] hold a permit to serve alcohol may continue to do so; however, any restaurant serving food only incidental to the consumption of alcohol may be construed to be operating as a bar…which are not allowed to operate at this time,” said a CHCC advisory.
To make certain that their restaurant is not operating as a bar, managers and owners are recommended to guide patrons to order meals, and not only alcoholic beverages, while at the restaurant.
Restaurants that will be found to be non-compliant may be closed.
