Woman sues Mango Resort over alleged injuries in fall
A woman is suing the owner of Mango Resort in As Perdido over the alleged injuries she suffered when she slipped and fell near the front desk building of the resort last Feb. 7.
Linda A. Fitial, through counsel Matthew J. Holley, asked the Superior Court to hold Blue Lagoon Realty Inc. liable for negligence and pay her damages in an amount to be proven at trial.
Fitial asked for a jury trial in case the mandatory mediation is unsuccessful.
As of press time yesterday, Saipan Tribune was still trying to get comments from Blue Lagoon Realty.
Holley
According to Holley in the complaint, Fitial, who was a guest of Mango Resort, was going down the steps at the front desk building when she slipped and fell. Holley said Fitial sustained “serious” physical injuries but did not indicate the specific injuries, besides saying that the plaintiff was unaware that the step was slippery.
Holley said the defendant breached a duty to ensure that all customers are free from unreasonable risks of harm when it failed to provide railing—posing a dangerous condition for persons such as Fitial.
He said the defendant also failed, among other things, to ensure that the floor was reasonably safe for individuals to walk on, provide visible warnings or markings on the steps, and provide adequate warning signs of the dangerous condition.
Holley said as a result of the recklessness and negligence of defendant, Fitial sustained injuries resulting in hospitalization, severe pain, and emotional and mental distress.
