US gov suit vs construction company over OSHA violations dismissed

U.S. District Court for the NMI Chief Judge Ramona V. Manglona dismissed Monday the U.S. government’s lawsuit against a construction company that seeks to collect the $38,489 civil penalties that the Occupational Safety and Health Administration assessed against the company for alleged OSHA violations in 2013 and 2016.

Manglona dismissed the U.S. government’s lawsuit against Northpac Corp. after both parties settled the matter.

Assistant U.S. attorney Jessica F. Wessling moved for the voluntary dismissal of the case as the terms of their settlement deal with Northpac Corp. have been satisfied.

Last August, attorney Joaquin DLG. Torres, counsel for Northpac Corp., Northpac Corp. general manager Miguel Cruz Jr., and Wessling informed the court that the parties have reached a settlement.

Under the settlement, Northpac will pay $27,894.43 for the first OSHA inspection and $8,537.90 for the other OSHA inspection, for a total of $36,432.33, within 90 days.
