Charge filed vs man who refused to leave ICE lobby
The U.S. government has charged a Chinese national with a criminal offense for refusing to leave the lobby of the Immigration and Customs Enforcement office in Gualo Rai despite being told to leave.
The information charges Cheng Jin with one count of failing to comply with lawful direction.
According to the charging information, Jin refused to comply with the order of a federal police officer to leave the premises of federal property on Oct. 24, 2019.
Jin had gone to the office to ask for help from federal agents, saying he is tired of his immigration case and that he could no longer afford to pay his attorney’s fee.
Department of Homeland Security-Federal Protective Service inspector Sean Patrick T. White arrested Jin for failure to comply with the directives of a federal police officer, and loitering or disrupting the performance of official duties.
At a hearing last Oct. 25, U.S. District Court for the NMI Magistrate Judge Heather Kennedy released Jin’s on his own personal recognizance.
Steven P. Pixley was appointed as counsel for Jin in this criminal case.
White stated in his affidavit in support of criminal complaint that he received a call from the Denver Mega Center last Oct. 24 at 1:47pm about a man at the ICE-Enforcement and Removal Operations office in Gualo Rai.
White said the DMC dispatcher stated that a deportation officer called to inform them that a man in the lobby refuses to leave after being told to do so several times.
