2 cases vs man in alleged burglaries, contempt are dismissed
Superior Court Associate Judge Joseph N. Camacho dismissed without prejudice Friday two criminal cases against a man who is accused of committing several burglaries and violating the terms of his bail conditions.
Camacho dismissed without prejudice the cases against 33-year-old Martin Castro Jr. at the request of the Office of the Attorney General. That means the OAG may re-file the cases in the future.
Castro will then be released from the Department of Corrections.
In the government’s motion to dismiss, assistant attorney general Heather P. Barcinas said the government believes that it is in the best interest of justice to dismiss the cases without prejudice.
Barcinas said she had communicated with assistant public defender Karie Constock, counsel for Castro, about the motion to dismiss and that the lawyer has no objections.
Saipan Tribune learned that the court had earlier stayed the cases pending Castro’s mental evaluations.
Last July, police arrested Castro after he was allegedly caught on surveillance camera breaking and entering a room at the Sunshine Garden in Susupe and taking a cell phone.
Police later learned that Castro was also involved in the theft incident at Mo’s Restaurant in Susupe last July after surveillance camera caught him walking into the establishment and grabbing the tip jar.
Police also identified Castro after surveillance camera’s footage showed him entering an establishment and stealing a Samsung S7 cellphone last July 24.
Castro was released to a third-party custodian and placed under house arrest.
Last August, police arrested Castro again for contempt after leaving the house without his third-party custodian’s knowledge.
Castro had been arrested several times in the past for burglary and theft cases.
