Man in document fraud pleads guilty, gets time-served sentence
An alleged overstaying tourist, who was found in possession of a CNMI driver’s license that he obtained through fraudulent papers, pleaded guilty in federal court last Wednesday and was sentenced to time served.
Guangyi He, a Chinese national, pleaded guilty to conspiring with others to produce an identification document illegally as part of a plea deal.
U.S. District Court for the NMI Chief Judge Ramona V. Manglona also placed He on supervised release for one year. He was ordered to pay a $500 fine and $100 in special assessment fee immediately after sentencing.
Assistant U.S. attorney Eric O’Malley appeared as counsel for the U.S. government.
According to the factual basis of the plea deal, He conspired with another person on Jan. 16, 2019, to obtain a CNMI driver’s license by presenting a falsified U.S. Citizenship and Immigration Services Form I-797 as evidence of lawful status in the CNMI in exchange for $1,500.
With the other individual’s assistance, He obtained the fraudulently obtained CNMI driver’s license on Jan. 18, 2019, and presented that license to a CNMI law enforcement officer on Aug. 26, 2019.
According to HSI agents, last Aug. 26, CNMI Department of Public Safety police officers conducted a traffic stop and encountered He, who was driving a car with three other Chinese nationals as passenger. He presented to the officers a CNMI driver’s license.
DHS records showed that He entered the CNMI on Dec. 17, 2017, and was granted a CNMI-only conditional parole by U.S. Customs and Border Protection that was effective only until Dec. 28, 2017.
