Hearing in suit vs CCC ends today

The preliminary injunction hearing requested by Imperial Pacific International (CNMI) LLC against the Commonwealth Casino Commission is scheduled to end today. Both parties will be giving their closing arguments and IPI will be presenting a summary of why they believe they are entitled to confidentiality when it comes to their financial statements.
After two days of litigation, CCC and IPI have reached the end of their witness list, submitted all evidence supporting their arguments, and are ready for the summation of the case and to present their closing arguments.
During the hearing yesterday, IPI lawyer Viola Alepuyo said that she would like to go ahead with the summation today; there are just a few tweaks she would like to make to the PowerPoint presentation they prepared.
One of the major modifications they wanted to make, Alepuyo said, was to include the testimony of expert witness David Burger, who completed his expert testimony yesterday.
“The PowerPoint that we have is really quite intensive because it lays out why a temporary restraining order is necessary, why the courts have said what the elements are and whether we’ve met those elements or not. Mr. [David] Burger was a huge witness and we want to make sure that we got all the important stuff that he said into the PowerPoint,” she said.
Burger, a certified public accountant in the CNMI, testified about the confidentiality of a business’ financial statements.
Despite objections from CCC lawyer Michael Ernest, who said they wanted to complete the summation yesterday, Superior Court Associate Judge Kenneth Govendo called for a recess and to resume the hearing today at 9am.
Govendo also said he wants to complete the summation and hear both closing arguments before lunch due to other judicial matters he has scheduled.
Govendo also stated last Tuesday that he would come up with an order after 10 days so that he can look over all the evidence and take into consideration the arguments made by both CCC and IPI.
