Russian national’s request to amend suit OK’d
A federal judge in the CNMI has allowed a Russian national to amend his lawsuit against the Federal Emergency Management Agency, saying the original lawsuit was not concise nor direct.
U.S. District Court for the NMI Chief Judge Ramona V. Manglona granted Thursday Milan F. Fargo’s request that he be allowed to amend his lawsuit.
Manglona noted that the current form of Fargo’s complaint against FEMA is neither simple or concise.
Fargo was given 14 days to file the amended complaint or his case will be dismissed with prejudice. That means Fargo will no longer be able to re-file the case.
In the original complaint he filed without a lawyer last Feb. 26, Fargo sued FEMA after it found him ineligible for some or all of the FEMA funds provided to him after Super Typhoon Soudelor in 2015 and demanding that he repay the money.
He claims that he only learned about this almost a year later when he got a debt collection notice for $4,217.
Last April 23, Manglona dismissed the complaint, saying that Fargo failed to exhaust all his administrative remedies. Fargo was, however, allowed to amend his lawsuit to add more facts. On May 3, Fargo responded to the court’s decision in the form of an email with 12 attachments.
