Judge wants to know defendant’s financial ability before sentencing

Before sentencing him, Superior Court Associate Judge Joseph N. Camacho wants to know the finances of a man who had pleaded guilty in a hit-and-run case that killed a pedestrian in As Mahetog last year.

In his order, Camacho said the sentencing memorandum/briefs that both prosecution and the defense counsel have submitted in the case against David Desebel Kapileo lacks some information as to his financial ability, history as to restitution, court costs, and probation fees.

Camacho said he needs more information to be able to impose a “careful and individualized sentence.”

He ordered the Office of Adult Probation to submit a presentence investigation report no later than July 12, 2019, and it should have information on Kapileo’s present ability, or past history of paying restitution, court costs, probation fees, and others.

The sentencing hearing will be held on July 31 at 9am.

The 51-year-old Kapileo pleaded guilty last Jan. 30 to homicide by vehicle and reckless driving.

The Office of the Attorney General had charged Kapileo with homicide by vehicle, driving while under the influence of alcohol, failing to stop after an accident causing injury or death, and reckless driving.

The OAG alleged that Kapileo was driving around 6:53pm on April 1, 2018, when he hit a pedestrian that led to the victim’s death.

Police arrested Kapileo, a habitual offender, on May 28, 2018.

The victim, a 38-year-old Chinese male, was hit by a Mitsubishi Montero vehicle at the corner of Chalan Pale Arnold Road and As Mahetog near the Saipan Ice and Water Co. on April 1, 2018.

The victim was pronounced dead at the Commonwealth Health Center that same day.

Police said that, according to a witness, after the Montero hit the victim, the driver kept driving south, then made a left turn on Mihaville in Garapan.

Police found the vehicle seven hours later.
