Judge denies man’s request for more ‘convenient sentence date’
A man who pleaded guilty to striking his girlfriend with a beer can requested the court to allow him to start his sentence after a month, immediately setting off the judge.
Superior Court Associate Judge Teresa Kim-Tenorio was a bit heated yesterday during a change of plea hearing held for Joaquin Delos Santos Jr.
Delos Santos pleaded guilty to count one assault and battery-domestic violence. Count two, disturbing the peace-domestic violence, was waived.
During his change of plea hearing, Delos Santos requested Kim-Tenorio to allow him to report to Department of Corrections after a month because he had just started a new job.
Kim-Tenorio responded saying that DOC is not a hotel to check in and check out when one pleases. “You don’t get to tell me when it is convenient for you to report to jail. You committed a crime and there are consequences. You should have thought about losing your job and your relationship with your children…before you committed the crime,” she said.
Kim-Tenorio denied Delos Santos’s verbal request and ordered that he report to DOC immediately following the hearing yesterday.
Delos Santos was sentenced to one year in prison and credited him for the one day he already spent in prison.
Delos Santos was also sentenced to supervised probation for one year following his imprisonment. He was also ordered to complete anger management classes on top of completing 150 community service hours.
Delos Santos was also obligated to pay a fine of $550, $25 court fee, and $120 in probation fees before the expiration of his probation.
Kim-Tenorio did waive the no contact rule that would keep Delos Santos from speaking to the victim. The victim personally requested that the provision be waived so that Delos Santos can still be involved with their five children.
Delos Santos is set for a review hearing on Jan. 8, 2019 at 9am where the court will issue a judgment and conviction order.

On July 25, 2018, Delos Santos struck his girlfriend in the face with a beer can because he was mad at her and had too much too drink.
