Former Commonwealth Utilities Corp. financial officer Matthew J. Yaquinto and CUC have agreed to an early conference for possible settlement in their court dispute.

At a status conference yesterday, U.S. District Court for the NMI Chief Judge Ramona V. Mangloña asked the parties about setting an early settlement talks.

According to the minutes of the hearing, David Banes, counsel for Yaquinto, agreed to settlement talks.

CUC counsel James S. Sirok agreed with Banes and suggested another status conference.

Mangloña set the matter for an early settlement conference to Jan. 22, 2019, before Magistrate Judge Heather L. Kennedy.

The deadline to file discovery responses is Oct. 1, 2018.

Yaquinto filed a discrimination lawsuit against CUC and five unnamed co-defendants in December 2017 over his termination as chief financial officer in May 2016, allegedly without cause.

CUC filed a counterclaim against Yaquinto for alleged unauthorized overtime pay, unauthorized wire transfers, and unsupported moving expenses.

CUC wants Yaquinto held liable to pay back the $49,399 in unauthorized overtime payments, damages representing wire transfer costs, $10,000 in moving expenses, as well as court costs, expert fees, and attorney’s fees.
