Terminated PSS exec asks court to allow her suit to proceed

Former education commissioner Cynthia I. Deleon Guerrero has asked the federal court to allow her lawsuit against the Board of Education and its members to proceed to trial.

In Deleon Guerrero’s opposition to a motion to dismiss her lawsuit, her lawyer, Brien Sers Nicholas, said that, although her contract with BOE allowed for termination “without cause,” she was let go because she would not go along with the illegal demands of the board and its members.

Nicholas said that Deleon Guerrero also accused the board of retaliation and not affording her any notice and an opportunity to be heard.

The lawyer said the BOE and its members argue for the dismissal of the case by focusing only on Deleon Guerrero’s claim for lack of notice and an opportunity, all the while forgetting Deleon Guerrero’s other allegations that her termination was “for cause.”

Deleon Guerrero is suing the BOE and its members for terminating her as the PSS commissioner last October. She is also suing the board members in their individual capacities.

She is demanding $350,000 in damages.
