Domestic violence charges vs woman dropped
Charges against a woman accused of punching her live-in boyfriend and running over his leg with a car during their argument at their home on Saipan has been dismissed at the request of the government.
The Office of the Attorney General may re-open the case in the future.
Superior Court Associate Judge Joseph N. Camacho dismissed the case against 26-year-old Pennie Lee Concepcion Cabrera last Friday at the request of assistant attorney general Teri C. Tenorio.
Tenorio said the government believes that mitigating circumstances to the benefit of Cabrera warrant further investigation.
Tenorio said that dismissing the matter without prejudice is in the interest of justice.
Cabrera was arrested recently for assault with a dangerous weapon, assault and battery, disturbing the peace, and reckless driving.
The Office of the Public Defender, counsel for Cabrera, has accused OAG of turning the preliminary hearing in the case into a sham proceeding by calling in to testify a police detective who allegedly does not know anything about the matter.
Assistant public defender Heather M. Zona asked court to dismiss the case for the government’s failure to meet its burden to establish probable cause to warrant the filing of the charges.
Cabrera allegedly punched her live-in boyfriend on the chest and reversed her car, running over his left leg during their argument over a text message at their residence on Saipan last Feb. 7.
