Lawsuit amended to add more information
The owner of an entertainment company amended on Wednesday his lawsuit against a former CNMI resident who is now based in Honolulu over the mothballed concert of the UB40 in Guam and Saipan in 2015.
Steven Brownstein, who owns Steven Brownstein Entertainment, filed the amended complaint after the U.S. District Court for the NMI dismissed last November his claims of fraud and unjust enrichment against former CNMI resident Jason H. Aldan.
Chief Judge Ramona V. Manglona found the allegations of fraud against Aldan were insufficiently pleaded.
Manglona said that nowhere in the complaint as it alleged that Aldan kept any of the funds that Brownstein transferred to him or that Aldan profited from the deal.
“Therefore, the unjust enrichment claim fails,” the judge said.
Manglona allowed Brownstein to amend both the fraud and the unjust enrichment claims.
Last April, Brownstein sued Aldan and Fredric Holloman and 10 unnamed co-defendants for allegedly defrauding the firm of $115,000 by misrepresenting to have UB40 perform in Guam and Saipan in 2015.
The amended complaint has same causes of action—fraud and unjust enrichment—against Aldan and 10 unnamed co-defendants. It contains more details, but removes Holloman as one of the defendants.
Brownstein, represented in the case by Steven P. Pixley, wants Aldan and co-defendants to pay him damages.
Pixley said that Aldan and others damaged Brownstein through a pattern of fraudulent misrepresentation relating to the performance of the UB40 band and the misappropriation of funds.
Pixley said the funds were transferred by Brownstein to Aldan and other individuals by wire transfer from the Bank of Hawaii in the CNMI to Hawaii and California.
Pixley said Brownstein wired the sum of $115,000 to Aldan and Holloman and that these funds were misappropriated.
Holloman, a resident of California, is allegedly engaged in business through an entity known as Shae Entertainment/Management in La Jolla, California.
Aldan, through counsel Robert T. Torres, previously moved to dismiss the claims against him. He asserted that Brownstein has not alleged any facts to show that he enriched himself and benefited.
