Prosecution, defense rest in the case of Guam resident

The prosecution and defense have rested their case in the ongoing federal jury trial of Melvin David Diaz, a 49-year-old Guam resident who is accused of impregnating a girl on Rota.

After calling to the stand several witnesses, assistant U.S. attorney Clyde Lemons Jr. rested the prosecution’s case on Thursday. Defense attorney David G. Banes also rested their case on Friday after calling in some witnesses.

U.S. District Court for the NMI designated judge Frances Tydingco-Gatewood, who presided over the trial, ordered the parties to hold closing arguments today, Monday, at 9:30am. The trial began on Feb. 6.

Diaz is charged with three counts of enticement of a minor and one count of travel with intent to engage in illicit sexual conduct.

According to the indictment, Diaz traveled from Guam to the CNMI between Aug. 1, 2010, and Sept. 30, 2010, to engage in illicit sex with the minor.
