No settlement reached between IPI, ex-employee
Efforts to reach a settlement between Imperial Pacific International (CNMI) LLC and a former employee have failed.
The settlement conference that was held last Dec. 8 ended with no settlement reached in the complaint filed by Dennis Campbell against IPI.
Campbell filed the complaint in federal court last August. He is suing Imperial Pacific for alleged violations of the American with Disabilities Act.
Attorneys Jeanne Rayphand and Shelli Neal represented Campbell at the settlement conference; attorney Kelley Butcher represented IPI.
Campbell is suing IPI because it allegedly discriminated against him by failing to provide him reasonable accommodation and failed to engage in a process required by ADA that resulted in his termination. Cambell is seeking back pay, interest, damages, attorney fees, and court costs.
Campbell was a casino table dealer, table games administrator, and later a table game supervisor. In April 2016, Rayphand said that Campbell told his supervisor that he was having trouble standing and walking for an extended period of time, but the casino management allegedly informed him that his best course of action would be the Family and Medical Leave Act.
Rayphand said that Campbell asked the IPI human resources department for reasonable accommodation and was asked for a doctor’s recommendation.
In June 3, 2016, Rayphand said Campbell was forced to resign, effective June 17, 2016.
