Court places suit on quarry permit RFP under advisement

A motion to prevent the Department of Public Lands from soliciting proposals for an exclusive quarry permit on public land in As Matuis has been placed under advisement.

Superior Court Associate Judge Joseph N. Camacho made the move yesterday in the motion for preliminary injunction filed by USA Fanter Corp. Ltd. against DPL last month.

Last October, USA Fanter, through counsel Robert T. Torres, asked the Superior Court to direct DPL and USA Fanter to negotiate on a quarry permit. If the two could not come to an agreement, only then would USA Fanter not block the awarding of the permit.

In the complaint filed, it stated that DPL issued a request for proposal for quarry operator on a 50,000-square-meter land in As Matuis. USA Fanter submitted a proposal on Sept. 16, 2016.

Last November, USA Fanter was informed by DPL that its proposal had not been selected. DPL initially selected Win Win Way but the two were unable to agree on terms that led to Win Win Way’s withdrawal.

DPL turned to Blue Oasis LLC, the second highest bidder, but the two were also unsuccessful in reaching an agreement. DPL issued another RFP.

USA Fanter protested the apparent cancellation of the previous RFP and filed a civil case against DPL.

As per court order yesterday, the parties shall file a proposed order on or before Jan. 12, 2018.
