Man gets 2 years in prison for burglarizing uncle’s house

A man got a two-year prison term yesterday for burglarizing his uncle’s house in Chalan Kiya.

David Palacios Deleon Guerrero, 28, pleaded guilty to burglary as part of a plea deal.

Superior Court Associate Judge Kenneth L. Govendo sentenced Deleon Guerrero to five years in prison, all suspended except for two years. He was given credit for 148 days of time served.

After completing his sentence, he will be placed on five years of probation. He was ordered to pay a $100 fine, $100 in court costs, plus probation fees. He was required to perform 160 hours of community service and write a letter of apology to his uncle and his family.

Chief Public Defender Douglas Hartig, who represented Deleon Guerrero, pointed out that this was not the typical burglary where copper wire or appliances or other items were stolen.

Deleon Guerrero broke into his uncle’s house and stole some canned goods.

According to court documents, police officers responded last March 27 to a reported burglary-in-progress at a house in Chalan Kiya. The officers surrounded the house and, when one officer opened the back door, Deleon Guerrero came out.

Police learned that the house owner had just installed a surveillance camera after noticing that items had been missing from their house. It was the house owner’s son who got notification from the surveillance camera about the burglary-in-progress. The son called the police.

The house owner recognized the burglar as his nephew.
