Man bites another man

A man is suing another man in Superior Court for allegedly biting his hand and hitting him with a chair during an apartment rent dispute.

Ye Fang also sought a temporary restraining order against Jiang Hong Sheng.

Fang, through counsel Charity R. Hodson, is suing Sheng for alleged battery, assault, and intentional infliction of emotional distress. He is demanding damages, attorney’s fees, and court costs.

Fang also asked the court to issue a restraining order and preliminary injunction against Sheng to prevent him from contacting, molesting, attacking and disturbing Fang, his wife, and their two children.

According to Hodson in the complaint, Fang lent Sheng $7,150 for a real estate investment about three months ago.

Fang and Sheng did not specify a time when the loan would be due in full.

By June 2017, the remaining balance due on the loan was $4,750.

Fang rents an apartment from Sheng in San Antonio. Fang’s rent had been paid up to July 2017.

Last June 6, Sheng messaged Fang that he was going to come over to Fang’s house to pay back the remaining balance due on the loan.

At Fang’s house, the two got into an argument because Sheng allegedly advised that he did not want to pay off the loan balance until Fang had moved out of the building.

Fang disagreed with Sheng’s proposal. Sheng allegedly got angry and yelled at Fang.

Sheng allegedly threatened Fang that if he keeps pushing him to pay back the money, he would make him “disappear.”

Sheng allegedly warned Fang that the latter has two children and that there are no security cameras on Saipan. Sheng allegedly stated he could throw Fang into the ocean.

Fang’s wife and his 3-month old baby were present during this argument and became frightened at the altercation.

Sheng allegedly suddenly grabbed Fang’s hand and bit it. Sheng grabbed a folding chair and hit Fang over the head about 10 times. Sheng also punched Fang.

Fang got up and went to the door to tell Sheng to leave. Sheng grabbed a kitchen knife and held it against Fang.

Fang’s child began crying. Fang’s neighbor and his wife heard the noise and entered Fang’s residence.

The neighbor demanded that Sheng put down the knife. During the struggle, Fang was able to get Sheng in a chokehold. Sheng eventually dropped the knife.

Fang secured Sheng with a telephone wire, while asking his neighbor to call the police.

Fang’s wife took several photos during this incident.

While waiting for the police to arrive, Sheng allegedly continued to threaten Fang, stating that he would sell his car and go back to China.

Sheng threatened Fang that before leaving Saipan he would “do something” to him.

Police officers arrived shortly after and secured Sheng. An ambulance brought Fang to the Commonwealth Health Center and was treated there last June 6, and incurred $900 in fees for treatment. When Fang went in for follow-up treatment, he paid $200 more.

Last June 7, after Sheng was released from police custody, he messaged Fang, “I’m back.”

That same day, Fang saw that Sheng had advertised on a Chinese website that his car on Saipan was for sale.

Last July 7, Sheng allegedly showed up outside Fang’s residence. Fang became alarmed and called the police. Sheng ran away before the police could capture him.

The following day, Sheng allegedly showed up again at Fang’s residence. Fang’s friend answered the door as Fang was not there.

Sheng allegedly told Fang’s friend that he was a plumber and was there to make repairs. Fang’s friend let him in.

Sheng then called the police. Fang’s friend called Fang to inform him that Sheng and the police were at the house.

Fang went to his house and found Sheng was telling the police that Fang was late with his rent so he was kicking him out.

According to Hodson, Sheng’s sublease to the apartment is subject to a superior lease with ZN (Saipan) Corp., whose authorized representative is Andrei Zhukovskii.

Hodson said ZN Corp. had terminated its sublease with Sheng and had agreed to sublease directly to Fang.

Hodson said Fang currently holds the lease to his apartment with ZN Corp. effective July 1, 2017, to July 1, 2018.

Zhukovskii came out of the building and told Sheng to leave. Fang called the police detective that was investigating the criminal assault with a deadly weapon case against Sheng.

The detective informed police officers of the ongoing investigation. Police then instructed Sheng to leave the premises.

Later that day, Fang noticed Sheng hanging around the area. Fang later discovered a notice from Sheng posted on his door stating that Fang is late on his rent and demanding payment for rent, utility charges, and a late fee, to be paid on or before July 15, 2017, or Fang would be evicted.

“Defendant’s violent acts and threats are outrageous in that defendant viciously attacked Mr. Fang and made threats toward Mr. Fang and his children,” Hodson said.
