Real estate owner sues IPI, official, others for non-payment of $100K
An owner of a real estate company is suing Imperial Pacific International (CNMI LLC) and its executive director and their three other companies for allegedly not paying a $100,000 broker’s fee.
Tim Goodwin, owner of real estate company Pacific Rim International, is suing Imperial Pacific International (CNMI) LLC, its executive director Lingli Cai, Imperial Pacific Properties LLC, Ever Harvest Ventures (CNMI) Ltd., and Harvest Ventures Properties LLC.
Imperial Pacific strongly believes that Goodwin did not earn the commission he claims and the company will vigorously defend this case and expects to prevail.
Goodwin, through counsel William M. Fitzgerald, is suing for fraud and breach of contract. He is demanding an unspecified amount of damages and a jury trial.
The lawsuit is assigned to Associate Judge Kenneth L. Govendo.
Imperial Pacific and co-defendants have yet to answer the lawsuit.
According to Fitzgerald in the complaint, Pacific Rim was retained in 2014 by David W. Dougherty to find a buyer for his property in Garapan, Saipan.
The lawyer said that, in 2014, representatives of Imperial Pacific International, owner of Best Sunshine International, contacted Goodwin to have Pacific Rim assist in securing properties to support its hotel and casino projects.
On Nov. 8, 2014, Goodwin told Dougherty that he had located a buyer who wants to buy the property for $1.3 million.
The agreement allegedly required the seller to pay a broker’s fee of $100,000 to be paid by the seller to Pacific Rim, resulting in a net to Dougherty of $1.2 million. The buyer under this agreement was to be Cai or her nominee.
Fitzgerald said no broker’s fee was ever paid to Pacific Rim or Goodwin.
