Angello cites 21-month delay in SSA case

John A. Angello had been waiting for 21 months for his complaint against the Social Security Administration to move forward yet the case had seemingly stalled.

Angello told the federal court yesterday that he has yet to be notified of any hearing in connection with his complaint over the alleged improper calculation of his retirement benefits, among other claims.

Angello said these “egregious delays” are “due to a forced and oppressive SSA appeal process” and are unjustifiable.

The federal court earlier dismissed Angello’s lawsuit against acting SSA Commissioner Carolyn W. Colvin. In an order in September 2016, Chief Judge Ramona V. Manglona of the U.S. District Court for the NMI granted Colvin’s motion to dismiss Angello’s suit for lack of subject matter jurisdiction. Manglona had also denied Angello’s motion to stay proceedings and directed the court’s clerk to close the case.

Angello is saying now that he would feel a sense of remissness to not notify the court of SSA’s continued “dilatory attitude.”

In her earlier dismissal of Angello’s case, Manglona had said the district court lacks jurisdiction to review SSA’s nonfinal actions.

Manglona said hopefully, the U.S. government’s counsel will continue to offer its assistance to Angello in communicating with the Hearing Office, and he will get a hearing within a reasonable time, taking into account that his is not the only review the Hearing Office has to schedule.
