U.S. District Court for the NMI Magistrate Judge Heather L. Kennedy on Wednesday entered a default judgment against three persons who are defendants in a racketeering lawsuit filed by a Korean businessman and his former company.

Kennedy said it appears from the record that the summons and complaint have been served upon Hu Jin An, Jeong Eun Taek, and Joann P. Hensley.

Kennedy said that An, Taek, and Hensley have failed to plead or otherwise defend themselves, as directed in the summons and provided in the Federal Rules of Civil Procedure.

“Therefore, notice is hereby given that default is entered against defendants Hu Jin An, Jeong Eun Taek, and Joann P. Hensley,” Kennedy, who is also the clerk of the court, said.

Plaintiffs Il Hwan Kim and KSA Corp., through counsel Pamela Brown-Blackburn, disclosed that they already served the summons and complaint on An, Taek, and Hensley.

Brown-Blackburn said An, Taek and Hensley failed to answer the lawsuit.

Kim and KSA alleged in their lawsuit that the defendants conspired to steal millions of dollars from him for his hotel and casino project on Saipan.

Aside from those three defendants, Kim and KSA Corp. are also suing former Public Lands secretary Oscar M. Babauta, former DPL employee Ramon S. Salas, and 10 unnamed co-defendants pursuant to Racketeer Influence and Corrupt Organizations Act and other causes of action.

The plaintiffs asked the court to hold the defendants liable to pay them damages, court costs, and attorney’s fees.

District Court of Guam Chief Judge Frances Tydingco-Gatewood will preside over the lawsuit.
