Man with ADHD gets time served for threatening to kill mother with machete
Jason De Castro Yamada, a 21-year-old man who has an attention deficit hyperactivity disorder and accused of threatening to kill his mother with a machete and physically abusing his younger brother, last week entered a guilty plea and was slapped with a prison term of one year, eight months, and five days.
Yamada signed a plea agreement with the government and pleaded guilty on Thursday to the offense of assault with a dangerous weapon.
Superior Court Associate Judge Teresa K. Kim-Tenorio accepted Yamada’s guilty plea and sentenced him to five years imprisonment, all suspended except one year, eight months, and five days for time served.
It means that the defendant will not serve more prison term. Yamada has been in custody since Dec. 13, 2014. He was placed on supervised probation for five years.
Among the conditions imposed is that Yamada shall maintain mental health treatment on outpatient basis or inpatient basis as recommended by the Commonwealth Health Center’s psychiatrist/doctor immediately upon release.
The defendant is not allowed to possess or consume any alcoholic beverages during the probationary period. He was ordered to pay a $500 fine at a rate of $10 per month.
The court dismissed the remaining charges as part of the plea agreement.
According to the factual basis of the plea deal, Yamada threatened his mother with a machete in his hand on Nov. 16, 2014 on Saipan.
Assistant attorney general Chester Hinds appeared for the government. Assistant public defender Michael Sato served as counsel for Yamada.
Detective Norman L. Skilling stated in his report that two police officers responded to a disturbing the peace incident at a residence in Dandan on Nov. 16 at 8:55am.
Skilling said Yamada’s mother told the officers that her son was harassing her while holding a machete.
The mother said Yamada fled the scene after she ran to the neighbor’s house to call the police.
The mother disclosed that Yamada has been diagnosed with ADHD but refused to take medication.
Yamada also would allegedly punch and kick his younger brother because he thinks that their mother is favoring the younger child.
