Customs trainee gets time served for domestic violence

Superior Court Associate Judge Joseph N. Camacho yesterday imposed a four-day prison term on a Customs trainee who struck his girlfriend in the face shortly after an argument at his residence on Saipan.

Joaquin Castro Fleming, 23, pleaded guilty to the offense of assault and battery (domestic violence).

Camacho granted Fleming’s guilty plea and sentenced him to one-year imprisonment, all suspended except four days.

Fleming was given credit for time served of four days. It means that he will no longer serve time in prison.

Fleming was placed on supervised probation for one year. He was ordered to pay a $500 fine, $100 in probation fee, and $25 in court costs.

Camacho ordered the defendant to attend alcohol counseling and batterer’s intervention as recommended by the Adult Probation Office.

He required Fleming to enroll and complete any additional counseling recommended by Adult Probation Office, including anger management counseling.

During the probationary period, Fleming is prohibited from consuming any alcoholic beverages or any illegal substances.

According to the factual basis of the plea agreement, Fleming struck his girlfriend in the face on March 9, 2016.

Police said according to the victim, she and Fleming argued, then he tickled her to the point of hurting her. He then slapped her repeatedly in the face. She suffered bruises on the left shoulder and left ear. She did not require any medical treatment.

At the change of plea yesterday, the victim addressed the court and requested a no stay away order from her.
