Man sues SS commissioner for allegedly denying him disability insurance benefits
A man who claimed to be disabled has filed a lawsuit in federal court against Social Security Commissioner Carolyn W. Colvin for allegedly denying him disability insurance benefits.
Matthew John Seman Fejeran, through counsel Pamela Brown Blackburn, asked the U.S. District Court for the NMI to reverse Colvin’s denial of his claim or remand the matter for further administrative proceedings.
Blackburn said Fejeran has exhausted administrative remedies in this matter and that the court has jurisdiction for judicial review.
Blackburn said Colvin denied Fejeran’s claim for disability insurance benefits as it was her determination that plaintiff is not disabled under the Social Security Act.
The lawyer said it is Fejeran’s contention that the denial of his disability claim is not supported by substantial evidence under the standards set forth by the statute and all other applicable laws and regulations.
Blackburn said the denial is also not supported by the weight of the evidence, plaintiff’s credibility, and medical opinions of his doctors.
