Company allowed to present evidence for restitution vs Melvin Ada

U.S. District Court for the NMI Chief Judge Ramona V. Manglona has granted the request of a Missouri-based company that had supplied dialysis and consumables and equipment to the Commonwealth Health Center to appear and be heard regarding its claim for restitution from Melvin G. Ada.

Ada is a former Commonwealth Healthcare Corp. employee who was slapped with 12.7 years in prison for stealing over $1.7 million from CHCC that was intended for the Missouri company Midwest Medical Supply Co. LLLC.

For “good cause having been shown” and there being no objection from the parties, Manglona granted Midwest Medical Supply’s request.

Manglona ordered that MMS may appear through counsel at the March 11, 2016, restitution hearing and present testimony by video conferencing related solely to the issue of restitution for the company.

MMS counsel Richard W. Pierce said in this perhaps unusual case, the U.S. government opposes restitution for MMS, while the U.S. Probation Office supports it.

Both the U.S. government and Ada are not opposing MMS’ request to be heard.

Ada was previously assigned as a medical supply specialist at CHC. His wife, Leyda, used to be a sales representative for MMS.

The court has granted the U.S. government’s motion for money judgment in the amount of $1.8 million, representing the total gross proceeds Ada obtained as a result of his criminal conduct.
