Camacho dismisses criminal case vs ex-CPA firefighter

Superior Court Associate Judge Joseph N. Camacho yesterday dismissed without prejudice the charges against a former Commonwealth Ports Authority firefighter who, while on probation, allegedly turned violent, pushing his brother, and challenging him to a fight.
Camacho dismissed the case against Giovanni Camacho Sablan as the Office of the Attorney General no longer wants to prosecute the matter by moving to drop the charges.
Assistant attorney general Darren Robinson stated that after further review of the file, the government is not convinced that sufficient evidence exists at this time to prove the charges set forth in the case beyond a reasonable doubt.
Robinson asked the court to dismiss the case without prejudice
Dismissal without prejudice allows the prosecution to re-file a new case on the same claim in the future.
The OAG charged the 24-year-old Sablan with assault and battery, and disturbing the peace.
According to OAG, on Dec. 16, 2011 at 8:35am, Sablan disturbed the peace and assaulted and battered his younger brother.
OAG said the defendant also disturbed the peace of his mother and younger siblings in his mother’s house where all parties reside in San Antonio.
OAG said Sablan, a former mixed martial arts fighter, was already on probation for a violent domestic matter when the incident happened.
When the last case was filed, the prosecution opposed Sablan’s request to release him on $500 cash and unsecured bond.
Then assistant attorney general Eileen Escudero Wisor stated in the government’s opposition that Sablan is a considerable danger to the community as his ability as a former MMA fighter and the use of “ice” is a deadly combination making his behavior virtually unpredictable and therefore impossible to ensure the safety of those around him and the community.
The prosecutor said it is clear that Sablan has no regard of CNMI laws or the court orders as this violation occurred while he was on probation for a similar offense.
In October 2011, Superior Court associate judge Perry B. Inos slapped a 58-day jail term on Sablan for assaulting his former girlfriend in the parking lot of a hotel in Chalan Kanoa.
