2 men get same 10-day prison term for instigating fight, domestic violence
A man was slapped with a 10-day prison term for instigating a fight, while another man was sentenced to a 10-day imprisonment for beating his girlfriend.
Superior Court Associate Judge Kenneth L. Govendo sentenced Edwin S. Desin to six months imprisonment, all suspended except 10 days, for disturbing the peace.
Desin, 47, was ordered to start serving the prison term last Thursday. He shall be released from jail on Feb. 13.
Superior Court Presiding Judge Robert C. Naraja sentenced Allan M. Nishimura to 30 days imprisonment, all suspended except for 10 days, for assault and battery (domestic violence).
Nishimura was given credit for 10 days of time already served. It means that the defendant will not serve more time in prison.
Desin and Nishimura are both placed on probation for one year following their release from prison.
Desin was ordered to, among other conditions, pay $399.34 in restitution to the victim, Ricarte Dulcero Cainiela, for injuries/damages resulting from the commission of this time.
In Desin’s case, according to the factual basis of the plea agreement, on Nov. 24, 2013, the defendant instigated a fight with Cainiela, causing several people to get involved and the police to get called.
In Nishimura’s case, according to the factual basis of the plea deal, on Dec. 26, 2015, the defendant caused bodily injury to his girlfriend after he slapped and choked her.
Police said Nishimura accused his girlfriend of having an affair.
