Company penalized $1K for DOL violations
An employer was fined a thousand dollars for multiple violations of the CNMI Department of Labor’s rules and regulations.
In an administrative order signed by hearing officer Jerry Cody, MDA Enterprises, Inc. was ordered to pay $1,000.
MDA Enterprises was initially denied a certificate of good standing by Labor due to the employer’s failure to file employer declarations, non-compliance with the requisite 30 percent workforce participation level, failure to submit copies of employer’s withholding tax records, and failure to submit total workforce listing documents.
The employer appealed the denial, based on its good faith offer to produce the missing documents and its promise to file employer declarations in the future.
The company’s president testified that if the company could not obtain a certificate of good standing, it would not be able to secure a two-year project with the Northern Marianas Housing Corp.
MDA Enterprise was given up to Dec. 4 to submit the missing documents. After it did so, the decision to deny the certificate was reversed. The ordered fine, however, still stands, although suspended for one year. It would be extinguished if the employer complies with DOL’s regulations.
The order states that MDA Enterprise should file a revised workforce plan, a quarterly total workforce listing documents and tax withholding documents, as well as to post future employer declarations on the department’s website.
