Man gets 30-day prison term for resisting arrest
A man accused of harassing and threatening to kill some people, including two police officers, while he was intoxicated, has entered a guilty plea and was slapped with a 30-day prison term.
Omar Raja Nawaz, 25, pleaded guilty last week to resisting arrest and disturbing the peace.
Superior Court Associate Judge David A. Wiseman sentenced Nawaz to a total of one year and six months imprisonment, all suspended except for 30 days, with credit for time served. That means he will no longer serve further prison term. He was placed on probation for 11 months.
During his probation, Nawaz is prohibited from possessing or consuming any alcoholic beverages or controlled substances. He was required to attend alcohol counseling and pay a $25 court assessment fee plus probation fees.
According to the factual basis of the plea agreement, on Aug. 28, 2015 on Saipan, Nawaz pulled his hand back while police officers attempted to place him in handcuffs and struggled against officers as they escorted him to a patrol vehicle.
Nawaz also threatened to kill Banga Bandhu Baidya and tried to break a bottle on Baidya’s head.
Police detective Daniel Maliuyaf stated in his report that the Department of Public Safety received a complaint about a man, later identified as Nawaz, who threatened to kill another man at a hotel’s beach concession in Garapan.
When two police officers responded at the scene, they detected a strong odor of alcohol from the suspect’s breath.
As the officers were escorting him to the police vehicle, Nawaz resisted and struggled. He allegedly tried to kick one officer and threatened to kill “all of them.”
