Superior Court associate judge David A. Wiseman has found probable cause to warrant the filing of charges against Juan B. Roberto, a former businessman who was arrested last Jan. 26 for allegedly harassing two witnesses in his prior gun shooting case.
During Friday’s preliminary hearing, Wiseman found probable cause to believe that the crimes of two counts of disturbing the peace, and one count of criminal contempt were committed.
Wiseman found probable cause to believe that the person who may have committed such offenses is the 52-year-old Roberto.
The judge ordered Roberto to answer the charges.
Arraignment will be today, Monday, at 9am.
Assistant attorney general Russell Lorfing represented the government at the hearing, while attorney Rosemond Santos is counsel for the defendant.
Roberto has been in custody for failing to post a $100,000 cash bail.
Detective Peter A. Aldan stated in his report that two women who are witnesses and victims in a prior case involving the defendant were at their residence in Dandan last Jan. 26 when Roberto began shouting in front of his house, next to the two women’s house.
Roberto then allegedly drove his pickup truck recklessly in front and around the two women’s residence. He accelerated the engine, causing the tires to spin, burning rubber. At the same time he was shouting profanities out the window of his truck.
One of the women tried to leave the house with her daughter, but as she was backing her car out of the garage, Roberto approached her side of the car holding a coconut.
The other woman remained inside the house and locked the front door. The women in the car quickly left, at the same time calling a detective on her cell phone.
Police officers responded and arrested Roberto. Both women were shaking with fear and were on the verge of tears when the officers arrived, police said.
Last Jan. 22, police also arrested Roberto at his residence for domestic violence. He allegedly admitted to firing off three live rounds of an unregistered gun in the presence of his girlfriend.
In July 2011, Wiseman issued a temporary restraining order against Roberto for allegedly making threatening gestures to attorney David Banes after a hearing on a contempt issue.
