White’s law firm sues massage parlor over advertising sign
Attorney Michael A. White’s law firm is suing a massage parlor for installing a sign in front of the entrance to his law firm in Susupe.
White asked the Superior Court to issue an order preventing Folucky Corp., owner of I Love Massage, from putting up any advertising signs unless it obtains approval from J.C. Tenorio Enterprises Inc.
White’s law firm and I Love Massage are both lessees at Joeten Center Building I, which faces Beach Road. White’s law firm is on the second floor, while I Love Massage is on the first floor.
The lawyer asked the court to stop I Love Massage from putting up any sign that extends above the level of the walkway, or is attached to the railing in front of his law firm.
White wants the court to order Folucky Corp. to remove the currently partially-installed sign and all supporting hardware there.
Saipan Tribune could not find I Love Massage’s contact number on the phone directory.
According to White, I Love Massage began installing a sign advertising its massage parlor business on Sept. 18, 2015, directly in front of the entrance to his place of business.
The sign, he said, was attached to the walkway, which provides access to his place of business, and to the railing that borders the walkway. The lawyer said the sign is more than 18 feet in width, and extends about 18 inches above the level of the walkway.
He said the sign is directly in front of the entrance to his place of business, and extends more than 10 feet to either side of the entrance.
He said Folucky Corp. has drilled numerous holes in the walkway, which may compromise its structural integrity and pose a danger to persons going into and out of his office.
He said the sign is attached to the railing by a number of metal strips that appear to him to be unsafe and are unpleasant in appearance.
He said the walkway and the railing constitute common areas of the building.
White pointed out that Section 7 of the lease provides that the common areas are “under the sole control of” J.C. Tenorio Enterprises.
White said he has no objection if defendant installs its sign below the level of the walkway. He said he has made numerous requests that defendant do so, but Folucky Corp. has consistently refused.
