15-month sentence pushed for woman in fake credit cards scam

Assistant US Attorney James Benedetto recommended a 15-month prison sentence for a Chinese national arrested on Saipan on charges of using fake credit cards.
In his sentencing memorandum, Benedetto said the government will recommend an imprisonment term at the low end of the guidelines range, which is 15 to 21 months, for Wing Yee Tse.
Tse, also known as Wing Yen Tse, pleaded guilty to two counts of access device fraud and two counts of misuse of immigration document as part of a plea deal.
The U.S. government further recommended that the court impose a three-year term of supervised release, an assessment fee of $100 for each count, and appropriate terms of supervised release for Tse.
The sentencing memo also noted the federal government’s response to Tse’s objections to the pre-sentence investigation report.
The memorandum stated, among other responses, that there is no merit to Tse’s contention that “all of the fraudulent conduct.was committed inside the United States.”
“Quite to the contrary, by defendant’s own admission, she was recruited in Hong Kong, and given detailed instructions about where to travel, what her role in the scheme was vis-à-vis her co-conspirators, what type of merchandise to buy, who to surrender it to, and what her cut would be,” Benedetto explained.
The government also disagreed with Tse’s assertion that she “is a good parent.” “Good parents do not embark upon criminal enterprises in foreign countries and thereby risk lengthy periods of separation from their children due to their incarceration.”
