Fire chief and co-defendants settle Saint Michael’s lawsuit

Department of Fire and Emergency Medical Services fire chief Thomas M. Manglona and other co-defendants in a lawsuit filed by the owner of private ambulance company Saint Michael’s Medical Response have reached a settlement deal.

At a settlement conference held in federal court on Friday, U.S. District Court for the NMI Magistrate Judge Heather L. Kennedy stated that the parties in August Healthcare Group LLC’s lawsuit have reached a settlement.

According to the minutes of the conference, attorney Braddock Huesman, counsel for August Healthcare Group LLC that owns Saint Michael’s Medical Response, agreed with Kennedy that they have reached a settlement and went over the terms of their deal.

Assistant attorney general Charles Brasington, counsel for Thomas Manglona, and attorney Joaquin Torres, counsel for defendants Joaquin Manglona and Marianas Global Ventures LLC, agreed with Huesman’s representation of the parties’ settlement terms.

Marianas Global Ventures owns Priority Care.

Huesman informed the court that a settlement agreement would be prepared and filed by Feb. 20, 2015.

August Healthcare Group filed the lawsuit in 2012. The company sued cousins Thomas and Joaquin C. Manglona, August Healthcare, and several others for allegedly conspiring to destroy the company’s business and help another then-newly formed ambulance company, Priority Care.

Joaquin Manglona is one of the members of Priority Care.

Since 2012, several motions have been filed that resulted in August Healthcare’s filing of an amended complaint a third time. The trial was supposed to start on June 22, 2015.

In his reply to the lawsuit, Thomas Manglona, through counsel Brasington, denied the allegations. He also asserted, among other things, that he is entitled to qualified immunity.

In Joaquin Manglona’s and Marianas Global Ventures LLC’s reply to the complaint, attorney Torres denied the allegations and asked the court to rule in their favor.
