Jones found at serious risk of not appearing in court
U.S. District Court for the NMI Magistrate Judge Heather L. Kennedy on Friday remanded Evengelyn E. C. Jones to the custody of the U.S. Marshal, after determining that there is a serious risk that Jones will not appear in court and that no reasonable condition will assure that she will not flee.
Kennedy said Jones, who was arrested by federal agents last week for failing to appear at a hearing, must be given an opportunity to consult privately with her court-appointed counsel.
A violating hearing will be held tomorrow, Tuesday, at 1:30pm.
Court-appointed counsel David Banes appeared at the hearing on Friday. Assistant U.S. attorney Ross Naughton appeared telephonically on behalf of the U.S. government.
U.S. Marshal Don Hall served Jones on Thursday with an arrest warrant that U.S. District Court for the NMI Chief Judge Ramona V. Manglona issued last Jan. 20.
Manglona issued the arrest warrant after Jones failed to show up at her revocation hearing.
Jones was first arrested on an indictment charging her with one count of visa fraud and was released last Nov. 24, 2014, on a $5,000 unsecured bond.
U.S. Probation officer Gregory Arriola then filed a petition for revocation of the defendant’s pre-trial release after she failed to appear for random drug tests on Dec. 16, 18, 20, and 30, 2014.
At the Jan. 20 revocation hearing, Jones did not show up in court.
Banes informed the court that since his appointment last Jan. 9, he has made many attempts to contact his client without success.
This prompted Manglona to order the arrest of Jones and vacated the trial date set for Feb. 2, 2015.
