Disbarred lawyer Quichocho, wife appeal to 9th Circuit
Disbarred lawyer Ramon K. Quichocho and his wife, Frances, are appealing to the U.S. Court of Appeals for the Ninth Circuit the federal court’s judgment holding them liable to pay $2.4 million in damages to businesswoman Jung Ja Kim.
The Quichochos want the Ninth Circuit to reverse the entry of judgment signed by U.S. District Court for the NMI clerk of court Heather L. Kennedy on April 3, 2014.
Kennedy issued the entry of judgment after a federal court jury reached a unanimous verdict on March 28, 2014, holding the Quichocho couple and his law firm liable to pay $2.4 million in damages to Kim.
The Quichochos also want the Ninth Circuit to reverse U.S. District Court for the NMI Chief Judge Ramona V. Manglona’s order issued on Dec. 15, 2014.
In that Dec. 15 order, Manglona denied the Quichochos’ motion to issue a judgment in their favor notwithstanding the jury’s verdict in Kim’s racketeering lawsuit against them.
Manglona ruled that because the Quichochos’ motion was untimely filed and that the Federal Rules of Civil Procedure circumscribe the court’s discretion to extend deadlines for judgment notwithstanding the verdict or new trial motions, she will deny the motion.
The Quichochos filed a joint notice of appeal and representation of statement in court on Tuesday.
Attorney Michael W. Dotts is counsel for Frances in the appeal, while Quichocho is representing himself.
