Assistant U.S. attorneys Eric O’Malley, James Benedetto, and Kirk Schuler will be leaving Saipan to relocate or fulfill overseas assignments, according to U.S. Attorney for the Districts of Guam and NMI Alicia A.G. Limtiaco yesterday.

“The U.S. Attorney’s Office is undergoing transitioning within our Saipan branch,” Limtiaco told the media after the Saipan Rotary Club’s general membership meeting at Hyatt Regency Saipan where she was a guest speaker.

Limtiaco stressed that O’Malley, Benedetto, and Schuler are not resigning.

Limtiaco said that one attorney will be moving closer to his home upon his contract’s expiration, while the other two will be fulfilling overseas prosecutorial assignments with the U.S. Department of Justice.

“These attorneys will be on term assignments,” she said.

The Saipan branch, she said, will be welcoming three new attorneys.

“We will be introducing them [new prosecutors] shortly. I’m just unable to going into details about them at this point,” she said.

Limtiaco said the transition will be occurring anywhere from Oct. 1, 2011, through November 2011.

Limtiaco refused to comment when asked if the turnover has anything to do with assistant U.S. attorney Beverly McCallum’s complaint before the U.S. Equal Employment Opportunity Commission.

Sources earlier said that McCallum and O’Malley had a “disagreement” in 2007 that ended with McCallum filing a complaint with the EEOC.

Limtiaco stated that these are not abrupt assignments for O’Malley, Benedetto, and Schuler. “In any office there is planning that takes place. These are not overnight or sudden assignments.”
