Probable cause is found to file charges vs sex offender

Superior Court Associate Judge Joseph N. Camacho has found probable cause to file five charges against Jose Albert Santos, a registered sex offender who was arrested recently for allegedly sexually abusing a 15-year-old boy since last month.

At a preliminary hearing Wednesday afternoon, Camacho determined that there’s probable cause to believe that the 53-year-old Santos may have committed three counts of sexual abuse of a minor in the second degree and two counts of disturbing the peace.

However, he found no probable cause for two counts of sexual assault in the first degree, saying these charges are contained in the two counts of sexual abuse of a minor in the second degree. He dismissed these two charges without prejudice.

Dismissed without prejudice means the prosecution can re-file the charges in the future.

Santos will be arraigned on Nov. 3. He was remanded into the custody of the Department of Corrections.

Assistant attorney general Margo Brown-Badawy argued for the government. Assistant public defender Benjamin Petersburg served as counsel for Santos.

Police said the alleged victim claimed that Santos began sexually abusing him early this year when he went to the suspect’s house to get a stick of cigarette.
