Suda pleads guilty, gets 30-day prison term in assault case

Daisina Suda, a woman who testified that she was forced to assist her then-boyfriend in raping a minor girl, yesterday entered a guilty plea and was slapped with a 30-day prison term for assaulting the former boyfriend last New Year’s Day.

Suda signed a plea deal with the government. Through counsel Samuel Mok, she pleaded guilty to assault.

Superior Court Associate Judge Kenneth L. Govendo accepted Suda’s guilty plea and the plea agreement.

Govendo sentenced the defendant to six months in prison, all suspended except 30 days.

Suda, 41, was given credit for 30 days that she already served in prison.

It means that she will no longer serve a prison term. She will be placed on one-year probation.

Assistant attorney general Chemere McField represented the government.

According to the factual basis of the plea agreement, on Jan. 1, 2014 on Saipan, Suda chased after Parvez MD. Barpery, yelled at him and threw a sharp instrument at him.

Detective Flora Danica B. Aguon stated in her report that on Jan. 1 at 11:02am, two police officers were dispatched to Lower Miha for a reported domestic violence incident.

Upon arrival at the scene, the two officers came across a shirtless and barefooted Bangladeshi man later identified as Barpery, who was running on the roadway.

Barpery flagged down the police officers’ vehicle. Barpery claimed that his then-girlfriend Suda was chasing him with a knife.

One officer walked toward Suda and asked her to stop from walking closer to Barpery.

Suda stopped and explained that her boyfriend beat her up. Barpery, however, directed the attention of the officer to a silver kitchen knife which was on the ground that she allegedly threw at him. He also showed his injury.

The boyfriend told police that he was resting inside his bedroom when Suda came and started asking for money. When he told her he already gave her money that previous night, she got mad and shouted bad words at him.

Suda then allegedly bit Barpery right below his right nipple so he pushed her away. She grabbed a kitchen knife and told him she was going to kill him.

Barpery ran outside to seek help, but Suda followed her and threw the knife at him. He was not hit and continued running away.

Last May, Superior Court Associate Judge Joseph N. Camacho slapped a maximum sentence of six months in prison against Suda, who pleaded guilty to disturbing the peace.

Suda was given credit for the time served.

Camacho said the defendant admitted in court that she participated in letting her then-boyfriend Barpery in allegedly sexually assaulting a 17-year-old girl inside San Jose Motel in May 2013.

As part of the plea deal in the sexual assault case, the government agreed to dismiss the charge of sexual assault in the first degree against Suda. She testified in the jury trial of Barpery.

After a two-day trial, a Superior Court jury unanimously found Barpery not guilty to the charge of sexual assault in the first degree.

Camacho, who presided over the trial and decided on the misdemeanor charge, also found Barpery not guilty as to the charge of disturbing the peace.

In explaining his verdict, Camacho found the testimonies of the government’s three main witnesses—the alleged victim, her cousin, and Suda—not credible.

Camacho said he believes that sex did in fact take place and the alleged victim agreed to have sex in exchange for money.
