Manglona dismisses lawsuit vs No Kai Oi

U. S. District Court for the NMI Chief Judge Ramona V. Manglona has dismissed a lawsuit filed by one of the incorporators of No Ka Oi Termite & Pest Control (Saipan) Inc., who sued the company for allegedly unlawfully terminating him as manager and refusing to pay his dividends as a shareholder.

Manglona dismissed with prejudice or finality the lawsuit filed by Joey D. Lopez Sr. after the parties in the case reached a settlement agreement and moved for the dismissal of the suit.

Manglona said each party shall bear their own costs and fees.

Attorneys William Fitzgerald and F. Matthew Smith, counsels for Lopez and No Ka Oi respectively, requested the court to dismiss the lawsuit.

The terms of the settlement agreement were not indicated in court papers.

In his lawsuit, Lopez, a resident of Guam, is demanding $103,000 or more in compensatory damages if the company’s profits are shown to be more than $40,000 a year for the years 2009 to 2012.
