Man gets 30-day sentence for hitting another with rifle butt

A man who hit another man with the butt of an air rifle and damaged another person’s vehicle pleaded guilty and was slapped with a 30-day prison term.

David Muña Sablan pleaded guilty last week to assault and battery in his 2008 criminal case and to assault and battery and criminal mischief in his 2011 criminal case as part of a plea agreement with the government.

Superior Court Associate Judge Kenneth L. Govendo sentenced the 33-year-old Sablan to a total of three years for both cases, all suspended except for 30 days, with credit for time served.

Upon his release, Sablan will be placed on three years’ supervised probation. He was required to undergo anger management counseling, drug and alcohol treatment and any other counseling recommended by the treatment provider or the Office of Adult Probation.

Sablan is prohibited from having contact with victims Komgish Tannakan and Andave Camacho Marcehadesch. He was ordered to complete 200 hours of community service, and pay a $500 fine and $400 probation fee.

According to the plea agreement, on March 1, 2008 on Saipan, Sablan intentionally punched and struck Marcehadesch in the head with the butt of an air rifle.

On May 22, 2011, on Saipan, the defendant pushed Tannakan up against his car and held him by his forearm and searched through his pocket. The defendant then threw a wine bottle at Tannakan’s car, causing damage to the vehicle.
