OAG wants probation of convicted robber revoked

The Office of the Attorney General has moved for the revocation of probation on man who was sentenced to an 18-month jail term in 2010 over an assault on a restaurant owner with a rock during a robbery.

Assistant attorney general Eileen Escudero Wisor said defendant Eric Aguon violated the terms and conditions of his suspended sentence.

Wisor said Aguon failed to obey all CNMI laws as he was arrested on Dec. 18, 2011 for disturbing the peace and for minor consuming alcohol.

Wisor said according to the Office of Adult Probation the defendant has not make any payments toward his court assessment fee of $100; has an outstanding balance of 492 hours of community work service; and has failed to report to the Community Guidance Center since the date of referral on Nov. 17, 2011.

In October 2010, Superior Court Presiding Judge Robert C. Naraja sentenced the then 18-year-old Aguon to seven years in prison, all suspended except 18 months, for assault with a dangerous weapon.

Naraja ordered Aguon to serve the jail term without the possibility of parole.

Aguon was given credit for the time he has been serving in jail since his arrest on May 1, 2010. The defendant’s release date was Nov. 1, 2011.

Aguon admitted that on May 1, 2010, he went into the Chang Won Restaurant in Chalan Kanoa armed with a rock, and threatened to injure the owner, Kyung Aea Jung, to get money.

The defendant and counsel signed a plea agreement with the government. He pleaded guilty to assault with a dangerous weapon. The remaining charges were dismissed.

Police officers learned that two individuals entered the restaurant, demanded money, and assaulted the owner with 2X4 lumber and large rocks.

Fearing for her life, the businesswoman gave cash to one of the suspects, then ran to the back room and sought assistance.

The surveillance camera in the establishment led to the identification of Aguon and his companion—a male juvenile.
