Man allegedly lied in passport application

A Tinian man who was acquitted last year of charges that he sexually abused a girl is now facing an indictment in federal court for allegedly filing a false statement to get a new U.S. passport.

Federal agents arrested 28-year-old Geoffrey Kim Cabrera on Monday on Tinian after the filing of the indictment, charging him with false statement in application for U.S. passport and perjury.

The U.S. government filed the indictment on Feb. 24 but the case was only unsealed on Tuesday at the request of the prosecution.

Cabrera appeared at the initial appearance hearing with court-appointed counsel, Robert Torres. He pleaded not guilty.

Assistant U.S. attorney Ross Naughton represented the U.S. government.

U.S. District Court for the NMI designated judge Robert C. Naraja set the trial for May 14, 2012, and allowed Cabrera’s release on a $5,000 unsecured bond.

According to the indictment, Cabrera lied in his application for a new U.S. passport when he said that his most recently issued passport had been lost. In fact, Cabrera surrendered it to the CNMI Superior Court on Dec. 23, 2009, as a condition of his pretrial release in the 2009 criminal case.

A Superior Court jury came back in May 2011 with a not-guilty verdict against Cabrera for the charge of sexual abuse in the second degree.
